Dying without a Will is known as dying intestate. If you die without a will, your estate is then divided based on the rules of intestacy. These are just a few common misconceptions about intestacy :-
Your spouse will not automatically receive everything and may have to share with your children.
Your partner with whom you have been living will not receive any financial benefit upon your death, no matter how long you have been together, as intestacy laws do not provide for cohabitants.
Your stepchildren will not receive any financial benefit if you don’t have a Will, as intestacy laws do not provide for stepchildren.

Inheritance Tax
This is another often confusing area that can be deciphered by our experienced estate planning solicitors; recent changes to Inheritance Tax regulations can greatly benefit you and may offset some tax issues. For example, upon the death of one member of a married couple or civil partnership, unused Nil Rate Band can be transferred over and applied to the estate of the remaining spouse or partner, which will then account for a decrease in Inheritance Taxes paid by the eventual beneficiaries.
Another practical method of mitigating the Inheritance Tax is the lifetime gift. If, after giving a lifetime gift, the giver lives for at least seven years, the value of the gift is no longer chargeable to Inheritance Tax when the giver dies.
