ENDURING & LASTING POWER OF ATTORNEY SOLICITORS
A Lasting Power of Attorney outlined in the Mental Capacity Act 2005 is a legal appointment of an individual to make important decisions on your behalf if you become mentally unable to do so for yourself. Lasting Power of Attorneys often face decisions about healthcare, finances, property, etc. There are two categories of Lasting Power of Attorney. The first includes the overseeing of finances, whereas the second focuses on handling the details and decisions related to your wellbeing. If you find yourself needing to appoint a Lasting Power of Attorney, you are free to choose one type over the other or both.
You are allowed to set forth specific requirements and limitations on your solicitor’s power in the Lasting Power of Attorney document and include advice for your solicitor on how to implement your wishes.
As the donor, you have the authority to revoke the Lasting Power of Attorney at any point while you have the mental capability to do so.
It should be noted that an 'Enduring' Power of Attorney executed prior to 1st October 2007 under previous legislation will still be valid notwithstanding changes implemented by the Mental Capacity Act 2005.

Lasting Power of Attorney For Financial Decisions
In implementing a Lasting Power of Attorney, you, the donor, are given the opportunity to choose who that solicitor will be. The actions that your solicitor is free to make are no different than those you would have the power to do. For instance, your solicitor can purchase property or put it up on the market, oversee your investments, handle bank accounts and obtain any benefits or retirement funds that you are eligible to receive.
You do have the option to appoint multiple solicitors; however, if you do so, you must set some guidelines as to whether they must always work collaboratively or if they can work on their own. You can tailor the details of their responsibilities to include both scenarios if you wish. You might decide that your solicitors do not have to collaborate in order to make basic financial decisions, such as simple transactions, but you may require that they consult each other for more major decisions, such as buying property.
There will be certain actions that your solicitor will not be able to do as a result of the boundaries you set when you appoint a Lasting Power of Attorney. For instance, you may choose not to give your solicitor the power to make donations in your name. If you decide to only implement the Lasting Power of Attorney when you are mentally unable to act on your own, medical substantiation may be necessary before a solicitor is allowed to fulfill his or her role.
You can communicate with your solicitor as to how they are to utilize their responsibility. This advice can be included in the Lasting Power of Attorney document or in a separate letter. It is however important to note that your solicitor cannot create a will on your behalf.
To complete the process of creating a Lasting Power of Attorney, a Certificate Provider will go through the document with you and certify that you are aware of the responsibilities you are entrusting to the solicitor. You also have the option to choose five people to be contacted when the application for Lasting Power of Attorney is submitted in case they are opposed to it. Lasting Power of Attorneys must be registered with the Office of the Public Guardian.

A solicitor who falls under this category frequently makes choices about your medical care and health issues. Many of the details involved in appointing this type of solicitor are the same as those for a financial Lasting Power of Attorney. The most fundamental difference is that this appointment only takes effect once you have become mentally incapable of making decisions for yourself. In that case, your solicitor arranges your living situation and medical treatment, oversees your care on a daily basis and chooses whether or not you should receive particular medical care.
